General terms and conditions of business
1. Scope
These general terms and conditions (GTC) apply to all orders placed by customers via our website easyheads.ch. By placing an order, you agree to the following conditions.
2. Contracting party
The purchase contract is concluded with EASY HEADS, Benjamin Woigk. Further information about us can be found in the imprint of our website.
3. Offer and conclusion of contract
The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the order button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of the order is sent immediately after the order has been sent and does not constitute acceptance of the contract. We can accept your order by sending an order confirmation by email or by delivering the goods within five days.
4. Prices and shipping costs
All prices quoted are in Swiss francs (CHF) and include statutory VAT. Shipping costs are included in the quoted prices.
5th payment
You can choose to pay by credit card, PayPal, or other payment methods specified in the ordering process. The purchase price is due immediately after conclusion of the contract, unless otherwise agreed.
6. Delivery conditions
We deliver worldwide. The delivery time and shipping costs vary depending on the delivery location and will be communicated to you during the ordering process. If not all of the ordered products are available, we are entitled to make partial deliveries, provided this is reasonable for you.
7. Retention of title
The delivered goods remain our property until full payment has been made.
8. Right of withdrawal
A right of cancellation is excluded, as our products cannot be exchanged or returned after opening for hygiene reasons. However, if the goods are damaged or faulty, please contact our customer service immediately.
9. Warranty
The statutory warranty provisions of the Swiss Code of Obligations (OR) apply. In the event of defects in the delivered goods, you are entitled to subsequent performance (remedy of defects or replacement delivery). Further claims are excluded unless otherwise provided for by law.
10. Liability
We are liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents:
- in case of intent or gross negligence,
- in case of culpable injury to life, body or health,
- within the framework of mandatory liability under the Product Liability Act.
We are only liable for minor negligence if essential contractual obligations (cardinal obligations) are violated. Liability is limited to foreseeable damage.
11. Data Protection
We only process your personal data in accordance with the applicable data protection laws in Switzerland. You can find further information on this in our privacy policy.
12. Dispute settlement
We are not obliged and fundamentally not willing to participate in dispute resolution proceedings before a consumer arbitration board. In the event of a dispute, the place of jurisdiction is the registered office of our company.
13. Applicable Law
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of the state in which the customer has his or her habitual residence remain unaffected.
14. Changes to the Terms and Conditions
We reserve the right to change these terms and conditions at any time. Changes do not apply to contracts already concluded.
15. Severability Clause
Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.
